Terms and conditions

All design services provided by RAANII Illustration & Design are subject to these Terms & Conditions. Please read them carefully before starting a project. If anything is unclear, please contact Rani Temmink, The Designer at contact@raanii.eu before accepting a quotation or booking a project.

In these Terms & Conditions, “Client” means the person or organisation commissioning the work. “Designer” refers to Rani Temmink, trading as RAANII Illustration & Design.

By accepting a quotation, signing a proposal, paying a deposit, or otherwise engaging the Designer’s services, the Client agrees to these Terms & Conditions.


No time to read everything? Here's a quick overview:

  1. A 50% deposit is required to secure the project before any work begins.

  2. Timelines may shift if there are delays in communication or feedback. To help keep the project on schedule, it's your responsibility to reply and provide feedback in a timely manner. 

  3. Concepts and ideas remain my intellectual property until final payment has been made.

  4. Revisions are included, but they’re not unlimited. If the scope grows significantly, additional costs may apply.

  5. Please check all work carefully before approval (spelling, details, etc.). Once approved, responsibility for any errors sits with you.

  6. Any additional requests outside the agreed scope will be quoted separately.

  7. If a project is cancelled partway through, payment is required for the work completed up to that point.

  8. Using AI to upload, reproduce, modify, or make the work available for training, developing, testing, or improving any artificial intelligence system is not allowed.

  9. You will receive the files for the purposes discussed. The source files will remain with me unless agreed otherwise.

  10. Final files are supplied via download. Please save these securely, as I don’t store all files long term.

  11. Unless agreed otherwise, I may share completed work in my portfolio and marketing.

Quote and Proposal

Quotations are based on the information provided by the Client and the estimated time required to complete the agreed scope of work. If the project scope changes or additional work is requested, the quotation may be revised. Quotations remain valid for 30 calendar days unless stated otherwise. Estimated delivery dates are provided in good faith but are not guaranteed.

Invoices are payable within 14 days unless otherwise agreed. Late payments may incur statutory interest and collection costs in accordance with Dutch law.

Deposit

To secure your booking, a non-refundable deposit of 50% of the quoted project fee is required before work begins. This secures The Clients place in The Designer’s schedule. The reimaining balance is payable upon completion of the project and before final files are delivered, unless otherwise agreed in writing.

Delays

The Client agrees to provide all information, materials, feedback, and approvals required to complete the project in a timely manner. If the Client causes a delay, the delivery timeline will be extended by the same amount of time as the delay.

Neither the Client nor the Designer will be considered in breach of this agreement if delays are caused by circumstances beyond their reasonable control. Such circumstances include, but are not limited to, natural disasters, government actions, power outages, fire, flooding, labour disputes, riots, war, terrorism, epidemics, or other unforeseen events. In these situations, any agreed deadlines will be extended accordingly. Both parties will make reasonable efforts to notify the other in writing as soon as possible if such a delay occurs.

If the Client does not respond or provide the required feedback, materials, or approvals for more than 30 consecutive days, the project may be considered inactive. In such cases, the Designer reserves the right to pause the project and reschedule the remaining work based on availability. Any additional costs resulting from prolonged delays or project reactivation will be communicated to the Client in advance.

Out of Scope

All services , deliverables and details of the project are outlined in the contract. If you request additional work outside of these services, a surcharge will apply. The Designer will communicate any extra costs beforehand. Out of scope could include additional revisions, additional concepts, extra illustrations, changes to the original brief, and new deliverables.

Faults and errors

The Client is responsible for carefully reviewing all proofs before providing final approval. Once written approval has been received, the Designer is not responsible for spelling mistakes, factual inaccuracies, printing errors or other issues that were present in the approved version.

Cancellations / Refunds

Either the Client or the Designer may cancel the project at any time by providing written notice. The 50% deposit secures the Client’s place in the Designer’s schedule and is non-refundable once work has commenced. Work is considered to have commenced once the project brief has been agreed, the quotation has been accepted, and the design process has started.

If the Client cancels the project after work has commenced, the Designer will invoice the Client for all work completed up to the date of cancellation. If the value of the completed work exceeds the deposit already paid, the remaining balance will be invoiced and is payable in accordance with these Terms & Conditions.

If the Designer cancels the project for reasons unrelated to the Client’s actions, any work not yet completed will not be charged, and any payment received for work not yet carried out will be refunded.

Upon cancellation, all rights, title, and ownership of any concepts, sketches, drafts, and completed artwork remain with the Designer unless otherwise agreed in writing. The Client may not use, reproduce, adapt, or distribute any work created before the cancellation unless the appropriate licence has been granted in writing.

Complaints

Complaints must be submitted in writing within 8 calendar days of receipt of the Work. Use of the Work by the Client or third parties constitutes approval. Complaints do not entitle the Client to suspend payments.

Attribution

For custom personalised illustrations, The Designer is at all times entitled to sign the work in an appropriate manner. The Designer reserves the right to be credited as the creator of the work wherever reasonably practical.

Delivery

Stated delivery times are indicative only. Exceeding them does not entitle the Client to compensation or termination.

Intellectual Property

Unless otherwise agreed in writing, all copyright and intellectual property rights remain with the Designer. Upon full payment, the Client receives a licence to use the final deliverables for the purposes described in the proposal or quotation.

Promotion & Licensing

The Designer may display completed work in portfolios, websites, exhibitions, social media and promotional materials unless otherwise agreed in writing. If you prefer that your artwork not be displayed, please let me know when placing the commission.

Use for Artificial Intelligence (AI)

Unless otherwise agreed in writing, the Client may not use, upload, reproduce, or make the Work available for training, developing, testing, or improving any artificial intelligence (AI), machine learning (ML), or generative AI system, including through datasets, databases, scraping, data mining, or similar processes. This restriction does not prevent the Client from using the final deliverables in the ordinary course of business or in standard software that includes AI-assisted features, provided the Work is not used to train or improve AI systems. Any AI-related use requires the Designer’s prior written permission and may be subject to a separate licence and additional fee. Unauthorised AI use will result in an immediately payable contractual penalty of €5,000 per violation, plus €1,000 for each day the violation continues, without prejudice to the Designer’s right to claim full compensation where actual damages exceed the penalty.

Source Files

Deliverables do not include original source files but only files in the format as specified in the Work definition of the contract. It shall be at The Designers discretion to make original source files available to The Client on request for a mutually agreed fee. Usage of source files shall be governed by the same terms that govern usage of the Work by The Client under this agreement.

File Storage

The Designer is not responsible for archiving project files indefinitely. It is recommended that you download and store any files sent to you in your own secure (cloud) storage system. Any links to files sent to you are temporary and purely for you to gain access to your files. After 30 days there will be a EUR 15,00 fee to resupply files/links. After 2 years the fee increases to EUR 40,00

RAANII Illustratoin & Design services may contain links to third-party web sites or services that are not owned or controlled by RAANII Illustration & Design. The Designer has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that RAANII Illustration & Design shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services. I strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Applicable Law and Disputes

All agreements are exclusively governed by Dutch law.
